Warehouse General Conditions of Service Contracting.
1.- DECLARATION: The customer / sender is solely responsible for the declaration of the content and the good packaging of the cargo. Any problem with the customs authority at the destination will fall directly on the sender who has not declared the total content and must assume payments for fines, fees, delays, warehouses and others generated at destination as stipulated by current legislation.
2.- DANGEROUS MATERIALS: Due to international regulations, as well as those that each country specifically establishes, those goods called «DANGEROUS» such as: fuels, acids, radioactive, explosives, weapons, etc. are not accepted. The shipment of liquids in the air service is limited depending on the destination, nature and quantity, so it will be necessary to consult details with our customer service area. Gases (nother liquid or not), are prohibited for transport.
3.- PROHIBITIONS: It will not be accepted for shipment: jewellery, stones and precious materials, any form of money, foreign currency, bank notes, shares, payment instruments (unsigned credit cards, checks, telephone cards, bills of exchange, bearer checks, cash, etc.), as well as the document that allows any payment, live or dead animals, weapons, drugs, pieces of art, merchandise that requires a temperature control, written or audiovisual publications prohibited by law, plants, hazardous material, leather garments, contest presentations, as well as goods prohibited by the customs authorities in the territory. For any dispute that may arise between the parties, the sole jurisdiction of the Spanish courts is agreed, which deals with commercial disputes, regardless of the origin or destination of the shipments.
4.- PACKAGING: The packaging will always be the sole responsibility of the customer. In the event that it is considered insufficient, indicated by us, you can reject the shipment. In no case does the acceptance of a shipment imply any responsibility on our part, regarding the suitability of the packaging, although you may reject any shipment whose packaging is evidenced as insufficient or inadequate.
5.- NON-IMPUTABLE DELAYS: The non-delivery of the transported goods due to absence or refusal of the recipient, deficiency of their data or non-payment of the amounts derived from the freight made (postage, insurance, taxes, expenses …), will be the responsibility of the sender, who will be obliged to bear, at his expense all the expenses of said incident including, where appropriate, the expenses of the return to origin or subsequent deliveries, and the impact of the corresponding insurance. Nature events, such as hurricanes or storms, that affect the means of transport, will not be attributable either. Customs delays of destination by fact not attributable to DDS-EU by GOPAZ LIMITED.
6.- DECLARED VALUE INSURANCE (MANDATORY INSURANCE FOR AIR SHIPMENTS TO COLOMBIA): The sender may request from the agency the contracting with the insurance company that it deems appropriate, of a supplementary insurance that covers, with a declaration of real value, the damage that the goods may suffer up to the declared value thereof. The price of this insurance will be 8% of the declared value (only 80% of the value will be recognised against invoice) – it must coincide with what was declared at the time of shipment (minimum amount 20 euros). If you do not contract this insurance, the contractual liability limits outlined in the different services will apply in any case. The above will not be altered by the necessary presentation of documents in which, to carry out the transit of goods, it is referred to its value or content, which will be considered as an extra-contractual declaration, and for the purposes of management before third parties.
7.- TRANSIT TIME: The transit days are (working days) are indicative and correspond to the shipment of cargo from the exit of the means of transport and not from the collection, delays not attributable to the company may extend the period until the impediment ceases to exist, it being understood that internal situations in the country of origin by different orders in the areas (political, social, economic, institutional) can affect the operation and delivery periods.
8.- CLAIM DEADLINES: In accordance with the provisions of Article 124 of the Air Navigation Law, the action to demand the payment of compensation for damages or losses prescribes 6 months from the date they occurred. The waiting time before proceeding to make the compensation is 21 working days from the time the claim is made. They must be in writing to the email. Claims for breakdowns or delays must be formalised in writing to the carrier from whom the service contract was requested, within 10 days of delivery or, failing that, on the date on which it should have been delivered. The aforementioned period is non-extendible and its non-compliance will prevent the exercise of the corresponding actions.
9.- LIMIT OF LIABILITY: The liability of the transport company for damages, losses or breakdowns suffered by the goods, is limited to a maximum amount of 2 euros / kg. In accordance with the provisions of the C.M.R. Convention, Protocol 5/7/78 (8.33 Units of Account/SDG. per KG.).
10.- FINAL DELIVERY: If the final address is outside the urban perimeter or an area of difficult access due to insecurity or any other reason that would endanger the integrity of the staff, the delivery will be made at a point to be coordinated with the recipient; if it is within the urban area it will be at home.
11.- DATA PROTECTION: We inform you in accordance with the provisions of the RGPD of April 27, 2016 that DDS-EU by GOPAZ LIMITED, collects and processes your personal data, applying the technical and organisational measures that guarantee your confidentiality, in order to manage the relationship that binds you. You give your consent and authorisation for such treatment. We will keep your personal data only as long as necessary to manage our relationship. 12.- INTERNAL REVIEW: The client (contractor) authorises DDS-EU by GOPAZ LIMITED. To carry out the opening of the order for the purposes of verification, validation, of its content in order to verify that it complies with what is stipulated by the company as materials and authorised transport goods; being able to detect prohibited objects restricted by law, make the respective return as well as inform the competent authorities.
13.- CUSTOMS PROCESS: For customs purposes, the customer must provide a copy of his identification document to be incorporated as exporter’s data before the customs authorities in compliance with the procedures of the matter.
14.- Liability for Transport: DDS-EU by GOPAZ LIMITED acts solely as an intermediary for shipping services and is not responsible for any loss, damage, or delay once the shipment has been handed over to the third-party transport company. The customer acknowledges and agrees that any claims related to the shipment’s delivery must be directed to the transport company responsible for the shipment. DDS-EU by GOPAZ LIMITED shall not be held liable for any issues arising after the shipment has been transferred to the carrier.
